{"id":19423,"date":"2023-09-15T09:00:00","date_gmt":"2023-09-15T14:00:00","guid":{"rendered":"https:\/\/satodayscatholic.org\/?p=19423"},"modified":"2023-09-12T11:02:51","modified_gmt":"2023-09-12T16:02:51","slug":"group-behind-abortion-initiative-sues-ohio-over-use-of-unborn-child-in-ballot-language","status":"publish","type":"post","link":"https:\/\/satodayscatholic.org\/group-behind-abortion-initiative-sues-ohio-over-use-of-unborn-child-in-ballot-language\/","title":{"rendered":"Group behind abortion initiative sues Ohio over use of \u2018unborn child\u2019 in ballot language"},"content":{"rendered":"\n<p>A group that is leading a ballot initiative to establish abortion rights in the Ohio Constitution sued state officials this week after a board finalized ballot language that uses the term \u201cunborn child\u201d rather than the group\u2019s preference to use the term \u201cfetus.\u201d<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"alignleft size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/satodayscatholic.org\/wp-content\/uploads\/2023\/09\/Ohio1.webp\" alt=\"\" class=\"wp-image-19424\" style=\"width:333px;height:222px\" width=\"333\" height=\"222\" srcset=\"https:\/\/satodayscatholic.org\/wp-content\/uploads\/2023\/09\/Ohio1.webp 670w, https:\/\/satodayscatholic.org\/wp-content\/uploads\/2023\/09\/Ohio1-300x200.webp 300w\" sizes=\"(max-width: 333px) 100vw, 333px\" \/><figcaption class=\"wp-element-caption\"><strong>Group behind abortion initiative sues Ohio over use of \u2018unborn child\u2019 in ballot language<\/strong><\/figcaption><\/figure><\/div>\n\n\n<p>Although the pro-abortion ballot initiative, titled Issue 1, is guaranteed to appear on the Nov. 7 ballots, the Ohio Supreme Court will need to decide what language voters will see when they enter the ballot box to cast their vote.&nbsp;<\/p>\n\n\n\n<p>The Ohio Ballot Board approved ballot language for Issue 1, which states that the proposed amendment would prohibit the government from restricting abortion \u201cbefore an unborn child is determined to be viable\u201d but would \u201calways allow an unborn child to be aborted at any stage of pregnancy, regardless of viability if, in the treating physician\u2019s determination, the abortion is necessary to protect the pregnant woman\u2019s life or health.\u201d<\/p>\n\n\n\n<p>Ohioans United for Reproductive Rights, which is an ad hoc pro-abortion group created to push the ballot initiative, argued in its lawsuit that any reference to an \u201cunborn child\u201d would introduce an \u201cethical judgment\u201d about \u201cwhat stage of development a zygote, embryo, or fetus becomes a \u2018child.\u2019\u201d The group&nbsp;<a href=\"https:\/\/www.supremecourt.ohio.gov\/pdf_viewer\/pdf_viewer.aspx?pdf=948468.pdf&amp;subdirectory=2023-1088%5CDocketItems&amp;source=DL_Clerk\" target=\"_blank\" rel=\"noreferrer noopener\">petitioned the Ohio Supreme Court<\/a>&nbsp;to order that the state provide voters with the exact language of the proposed amendment, rather than use the language finalized by the board.<\/p>\n\n\n\n<p>\u201cIssue 1 was clearly written to protect Ohioans\u2019 right to make our own personal health care decisions about contraception, pregnancy, and abortion, free from government interference,\u201d Ohioans United for Reproductive Rights spokeswoman&nbsp;<a href=\"https:\/\/www.acluohio.org\/en\/press-releases\/ohioans-united-reproductive-rights-challenge-deceptive-ballot-language\" target=\"_blank\" rel=\"noreferrer noopener\">Lauren Blauvelt said in a statement<\/a>.&nbsp;<\/p>\n\n\n\n<p>\u201cThe summary that was adopted by the ballot board is intentionally misleading and fails to meet the standards required by Ohio law,\u201d Blauvelt added, according to a Catholic News Agency report.<\/p>\n\n\n\n<p>The proposed amendment would add a new section to the state constitution that would create a \u201cright to reproductive freedom.\u201d It would prohibit the government from restricting abortion before viability. If a physician, such as the mother\u2019s abortionist, determines the pregnancy is a threat to her life or health, then that abortion right would extend up until birth.&nbsp;<\/p>\n\n\n\n<p>Viability usually occurs at about 24 weeks of pregnancy, but the amendment\u2019s language fails to include a strict cutoff. Rather, the physician, which could be the mother\u2019s abortionist, is allowed to determine viability on a case-by-case basis.<\/p>\n\n\n\n<p>Ohioans United for Reproductive Rights raised several other objections to the board\u2019s ballot language. One of their other primary concerns is that the language fails to mention the other rights established in the proposed amendment, which goes further than abortion.&nbsp;<\/p>\n\n\n\n<p>In addition to the right to an abortion, the proposed amendment would also create a right to make decisions about contraception, fertility treatment, continuing one\u2019s own pregnancy, and miscarriage care. The board-approved language makes no mention of these elements of the amendment, which the group claims violates the board\u2019s legal obligations.<\/p>\n\n\n\n<p>The group also objected to other aspects of the way the ballot was written, such as the use of words like \u201conly\u201d and \u201calways,\u201d which it alleges, in its lawsuit, is done to \u201cplay up contrasts where none exists and warps negative language into positive language to suggest the state\u2019s intrusion into private affairs.\u201d The lawsuit claims \u201cthe ballot language aims to persuade against the amendment.\u201d<\/p>\n\n\n\n<p>\u201cThe ballot language\u2019s length and the context in which it was drafted confirm that the above defects are no accident but are, instead, part of a deliberate attempt to mislead and sway voters,\u201d the lawsuit argues.&nbsp;<\/p>\n\n\n\n<p>Ohioans United for Reproductive Rights asked the court to order that the state include the full text of the amendment or to prescribe the changes that must be made and retain jurisdiction to ensure the order is followed.&nbsp;<strong><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A group that is
